The AP reported that Republicans "have called on [President] Obama to veto a pending $410 billion spending bill because it includes more than 8,000 earmarks," without noting that many of the earmarks were included at the request of Republicans. Read More
ABC's Gibson falsely claimed Obama "campaign[ed] on a promise to end pet projects"
On ABC's World News, Charles Gibson advanced the false claim that prior to President Obama's statement that he would sign an omnibus appropriations bill that includes earmarks, Obama "campaign[ed] on a promise to end pet projects, earmarks." In fact, Obama had actually promised to reform the earmark process and cut wasteful spending, not eliminate earmarks altogether. Read More
O'Reilly misrepresented Obama remark to falsely claim he "pledg[ed] ... to end earmarks"
Bill O'Reilly aired a clip of President Obama stating, "We are going to ban all earmarks, the process by which individual members insert pet projects without review," which he falsely characterized as "President Obama pledging last January to end earmarks in federal spending." In fact, Obama was referring to his desire to "ban all earmarks" from his "recovery and reinvestment plan," which he specifically distinguished from "the overall budget process." Read More
Fox News' Kilmeade echoes charitable donation deduction falsehood
On Fox & Friends, Brian Kilmeade falsely asserted that President Obama has proposed eliminating the ability of taxpayers to take income tax deductions for their charitable contributions. In fact, Obama has not proposed eliminating the charitable donation income tax deduction for any taxpayers. Rather, a provision in Obama's budget proposal would, beginning in fiscal year 2011, reduce the tax rate at which families earning more than $250,000 per year can take itemized deductions to 28 percent. Limbaugh conservatives continue 75-year-old "socialized medicine" smear
As President Obama lays the groundwork for releasing his plan to reform the country's health-care system, Rush Limbaugh responds on cue with a pre-emptive attempt to undermine reform efforts with the tired smear of "socialized medicine." Just how tired? Very -- it is at least three-quarters of a century old. Media Matters found that as far back as the 1930s -- with respect to at least 16 different proposals -- conservatives have volleyed attacks on progressive efforts at health-care reform with the clichéd -- and false -- label of "socialized medicine." Wash. Post's Connolly baselessly put "estimates" of Obama's health-care plan at "$1 trillion each year" for "some time"
Discussing President Obama's health-care plan on MSNBC Live, The Washington Post's Ceci Connolly baselessly asserted that "estimates" for the plan put the cost at "$1 trillion each year." However, Connolly wrote in a Post article on the plan that its estimated total -- not yearly -- cost is at least $1 trillion, while other outlets have reported that the plan is expected to cost more than $1 trillion "over 10 years." Dobbs said poll shows Obama's "honeymoon with Americans on the economy" is ending -- but poll hasn't changed
Lou Dobbs claimed that "President Obama's honeymoon with Americans on the economy appears to be at an end," asserting that the latest Wall Street Journal/NBC News poll showed that "only 54 percent of Americans say the president has the right goals and policies for this country." However, the survey results for the same question from the previous two months' polls are nearly identical. Read More
Fox News' Hemmer allowed former CEO of scandal-plagued hospital firm to spread stimulus health care falsehood
On America's Newsroom, Bill Hemmer allowed Richard Scott, whom Hemmer did not note resigned as chairman of HCA, Inc. amid a federal investigation, to falsely claim that a provision in the stimulus bill allows the federal government to "take away" some of patients' health care "choices." In fact, the provision in question allocates funds for the research of "the comparative effectiveness of health care treatments and strategies," but in no way does the law empower the council to dictate which treatments may or may not be prescribed. Wash. Post uncritically reports "socialized medicine" rhetoric about Obama's health care plan
In an article on President Obama's health care plan, The Washington Post reported that Conservatives for Patients' Rights is promising to launch a multimillion-dollar ad campaign "warning that the country is hurtling toward socialized medicine." The Post did not provide any basis for the charge, nor did it note that, in fact, Obama is not proposing "socialized medicine." Read More
Following Drudge, media compare Obama to Nixon, cite purported "enemies list"
After Matt Drudge posted the headline "ENEMIES LIST: WHITE HOUSE PLOTS LIMBAUGH COVERAGE" on his website, several media figures -- including Rush Limbaugh, Lou Dobbs, Tony Blankley, and Newt Gingrich -- advanced Drudge's claim that Obama, like President Nixon, had an "enemies list," or compared the Obama White House to the Nixon administration. Hume ignored climate experts to assert significance of purported global cooling trend
Fox News' Brit Hume asserted that "climate alarmists certainly did not foresee the cooling trend of the past decade" and, therefore, the Obama administration is premature in implementing cap-and-trade policies to curb global warming because it is merely a "scientific consensus" and "something that is not yet a fact." In fact, according to climate scientists, the temperature data continue to show a long-term upward trend in global surface temperature, and a cooling trend would need to last longer than a decade before it could be distinguished from the natural variability in the Earth's global surface temperature. Fox's Garrett exaggerated in claiming Obama's statistic on bankruptcies tied to health costs is "[n]ot even close"
At a March 5 health-care forum, President Obama said, "The cost of health care now causes a bankruptcy in America every 30 seconds." On Special Report, Major Garrett reported that when asked to support that statistic, the White House cited a 2005 op-ed by Harvard law professor Elizabeth Warren in which she referred to a Harvard study that supports the statistic. But Garrett did not note this. Instead, he referred to Treasury Department statistics from 2000 and pronounced Obama's assertion "[n]ot even close." Read More
False advertising: Beck show promo denounced calling Dems communists, but he often does that on his show
In a January promotion for his then-upcoming Fox News program, Glenn Beck denounced those who accuse Democrats of leading America toward communism: "I'm tired of the politics of left and right. It's about right and wrong. We argue back and forth -- 'If you haven't voted for the donkey, you're just a hatemonger.' The other side -- 'Oh, those donkeys trying to turn us into communist Russia.' Stop!" But since his show premiered, Beck has repeatedly used his program to smear President Obama, Democrats, and their policies as communist -- and Marxist, socialist, and fascist. Read More

In reporting that the AFL-CIO's executive council will push the Obama administration "to call for moving more aggressively on nationalization" to "counter Republican and business cries against it" and that "[l]abor leaders said the administration appeared to be vacillating on nationalization partly out of fear of Republican attacks that it was adopting socialist policies," The New York Times did not mention Sen. On CNN's Lou Dobbs Tonight, Ed Henry falsely suggested that President Obama's proposals to allow the Bush tax cuts to expire and to increase the capital gains tax rate would affect taxpayers in all income brackets. In fact, Obama has proposed allowing the Bush tax cuts to expire -- and increasing the capital gains tax rate -- only for individuals earning more than $200,000 in income and for joint filers earning more than $250,000 per year. In CNBC host Cramer's "U.S.S.A.": "Comrade[]" Obama is a "Bolshevik" who is "taking cues from Lenin"
CNBC's Jim Cramer has repeatedly characterized President Obama and congressional Democrats as Russian communists intent on "rampant wealth destruction," claiming Obama is "taking cues from Lenin" and using terms such as "Bolshevik," "Marx," "comrades," "Soviet," "Winter Palace," and "Politburo" in reference to Democrats. Fox News hosts falsely asserted that doctors could be jailed for refusing to perform abortions under Obama administration
In separate reports, Fox News' Bret Baier and Megyn Kelly misrepresented the reported plans of the Obama administration to rescind a December 2008 Bush administration regulation to falsely assert that the Obama administration's decision could result in doctors' being prosecuted or discriminated against for refusing to perform abortions. In fact, federal law -- which the Obama administration cannot "repeal[]" -- prohibits public officials from requiring recipients of public funds to perform abortions or sterilizations in violation of their religious or moral beliefs. Solicitation for Second Chance Act Grants to State and Local Governments Released Today

On February 27, 2009, the Bureau of Justice Assistance (BJA), U.S. Department of Justice, released the solicitation for Second Chance Act grants to state and local governments for adult reentry demonstration projects (Section 101). Funding under this section is available to help state and local agencies implement programs and strategies to reduce recidivism and ensure the safe and successful reentry of adults released from prisons and jails.

The deadline for applications is 8:00 p.m. EST on April 20, 2009.

The solicitation for the nonprofit grants (Section 211) will be released by BJA at a later date. The Office of Juvenile Justice and Delinquency Prevention (OJJDP) will issue a separate solicitation in the coming weeks for Juvenile Demonstration Project grants for state and local governments and Indian tribes.

Coming soon: The Justice Center's Second Chance Act Toolkit
The Council of State Governments Justice Center is working with its reentry partners to develop a toolkit to help potential applicants. This toolkit will include a number of useful materials:
  1. A checklist that will help state and local governments meet application requirements
  2. FAQs about the Second Chance Act and Section 101
  3. Fact sheets about the grant programs authorized by Section 101, Section 211, and Section 212 of the Second Chance Act
  4. A resource guide listing other publications, reports, and tools that may be helpful in developing a successful reentry initiative
This toolkit will be available in the coming weeks on the Reentry Policy Council website. The Justice Center also is planning a series of webinars to help potential applications understand the solicitation for Second Chance Act grants and answer common questions. The dates and times for these webinars will be released in an upcoming announcement.

U.S. House of Representatives Approves Over $133 Million for Prisoner Reentry in FY 2009, including $25 Million for the Second Chance Act
On February 25, 2009, the House of Representatives passed an omnibus appropriations bill for the remainder of fiscal year 2009, which includes funding for the Department of Justice, the Department of Labor, and the Department of Health and Human Services. The omnibus bill (H.R. 1105) is now under consideration in the Senate. Democratic leaders hope to take action on this bill by the end of next week, as the continuing resolution currently providing funding expires on March 6, 2009.

The American Recovery and Reinvestment Act of 2009
On February 17, 2009, the President signed into law H.R. 1, the American Recovery and Reinvestment Act of 2009. This stimulus bill provides nearly $4 billion for criminal justice grant programs.

President Obama Requests $75 Million for the Second Chance Act in FY 2010
In the preliminary budget for fiscal year 2010 released on February 26, 2009, President Obama requested $109 million for prisoner reentry programs, including $75 million for Second Chance Act programs. "I am indeed pleased that the President's proposed budget includes $75 million for Second Chance and I applaud him," said Second Chance Act sponsor Rep. Danny Davis (IL). "This investment of $75 million will bring tremendous returns. However, throughout the budget and appropriation processes, I shall be advocating and working for more."

Sign Letters to Support Second Chance Act Funding
A national reentry working group is leading the effort to secure funding for the Second Chance Act for fiscal year 2010, which begins on October 1, 2009. The working group is circulating a sign-on letter asking Congress to fund Second Chance Act programs in FY2010.

"We have all worked so hard to get this legislation passed, but we know it will not accomplish what it is intended to do without sufficient funding. We must encourage policy makers to appropriate the needed funds," said working group member Jane Browning of the International Community Corrections Association. According to fellow working group member Gene Guerrero of the Open Society Policy Center, "it is important for organizations that support the Second Chance Act and federal funding for reentry programs to sign this letter of support."

Second Chance Act Prisoner Reentry Initiative
The Second Chance Act will help ensure the transition individuals make from prison or jail to the community is safe and successful. Section 101 provides grants to state and local governments and federally recognized Indian tribes that may be used for demonstration projects to promote the safe and successful reintegration into the community of individuals who have been incarcerated.
Application Deadline: April 20, 2009

Justice and Mental Health Collaboration Program
The Justice and Mental Health Collaboration Program seeks to increase public safety through innovative cross-system collaboration for individuals with mental illness or co-occurring mental health and substance use disorders who come into contact with the criminal justice system. The Bureau of Justice Assistance is seeking joint justice and mental health applications from eligible applicants to plan, implement, or expand a justice and mental health collaboration program.
Application Deadline: March 12, 2009

Indian Alcohol and Substance Abuse Program (IASAP)
The Indian Alcohol and Substance Abuse Program (IASAP), administered by the Bureau of Justice Assistance (BJA), provides funding and technical assistance to federally recognized tribal governments to plan, implement, or enhance tribal justice strategies to address crime issues related to alcohol and substance abuse. Priority will be placed on law enforcement-led strategies which focus on controlling and preventing alcohol and substance abuse in Indian Country.
Application Deadline: March 12, 2009

Adult Drug Court Planning and Training
The Bureau of Justice Assistance's (BJA) Adult Drug Court Planning and Training Program supports the Adult Drug Court Discretionary Grant Program (42 U.S.C. 3797u et seq.), which assists communities to develop effective drug court strategies for nonviolent1 substance-abusing offenders through two components. The first component, the Adult Drug Court Initiative, assists jurisdictions in the planning and development of new drug court programs; the second component, the Adult Drug Court Training Initiative, offers a menu of training options to access and incorporate into local, regional and, statewide drug court training events.

U.S. House of Representatives Approves Over $133 Million for Prisoner Reentry in FY 2009, Including $25 Million for the Second Chance Act
On February 25, 2009, the House of Representatives passed an omnibus appropriations bill for the remainder of fiscal year 2009, which includes funding for the Department of Justice, the Department of Labor, and the Department of Health and Human Services. The omnibus bill (H.R. 1105) is now under consideration in the Senate. Democratic leaders hope to take action on this bill by the end of next week, as the continuing resolution currently providing funding expires on March 6, 2009.
The omnibus bill passed by the House includes funding for the following criminal justice priorities:
  • $25 million for the Second Chance Act, including $15 million for state and local demonstration grants and $10 million for nonprofit grants
  • $108,493,000 for Department of Labor ex-offender activities
  • $10 million for the Mentally Ill Offender Treatment and Crime Reduction Act (which represents a $3.5 million increase over the FY08 appropriation)
  • $532 million for the Byrne Justice Assistance Grant (JAG) Program
  • $30 million for the Byrne Competitive Grant Program
  • $40 million for drug courts
  • $400 million for the State Criminal Alien Assistance Program (SCAAP)
  • $10 million for Residential Substance Abuse Treatment (RSAT)

President Obama Requests $75 Million for the Second Chance Act in FY 2010
In the preliminary budget for fiscal year 2010 released on February 26, 2009, President Obama requested $109 million for prisoner reentry programs, including $75 million for Second Chance Act programs. "I am indeed pleased that the President's proposed budget includes $75 million for Second Chance and I applaud him," said Second Chance Act sponsor Rep. Danny Davis (IL). "This investment of $75 million will bring tremendous returns. However, throughout the budget and appropriation processes, I shall be advocating and working for more."
